Bally and its subsidiaries and affiliates are part of the Labelux Group GmbH group of companies (collectively referred to as the “Group” in this privacy policy).

The Bally online store (the "Bally Online Store"), which can be accessed from the website www.bally.com is part of said website of which Bally is the exclusive data controller. The Bally Online Store is managed by the company YOOX, duly appointed as Data Processor, within the limits of the role.
Without prejudice to the above, the company YOOX S.p.A. ("YOOX"), based in Via Nannetti 1 in Zola Predosa (Bologna), deals with managing sales and transactions carried out through the Bally Online Store, such as processing orders, sale and delivery of products, processing returns and warranties and other activities necessary for the sale of products through the Bally Online Store. For the managing and the implementation of activities required for the sale of products through the Bally Online Store, YOOX processes, as the independent Data Controller and in accordance with the relevant privacy law, users data such as name and surname, address and user credit card details. The present conduct guidelines concerning privacy (the "Privacy Policy") are applicable for the website www.bally.com and the Bally Online Store dedicated to e-commerce (hereinafter collectively referred to as the "Site") and refer to the processing of personal data carried out by Bally during Site navigation and user interaction with the services and features offered through the Site. 1. The nature and kind of data processed

1.1 Surfing data
The computer systems and processing programs required to run the Site log, during their normal operation, certain data whose acquisition is automatic and inevitable (whenever Internet protocols are used) and which, for their own nature, may allow the identification of the users if they are processed and associated with other data owned by third parties. Bally does not collect Surfing Data in order to be associated with to users or identified persons. Surfing data are collected and processed by Bally exclusively for statistical purposes and in anonymous form in relation to the access of the Site and for purposes of monitoring the correct functioning of the Site and of enhancing the Site functioning and content.

Personal data collected will be stored and processed via an electronic system managed by YOOX located in Bologna which had been duly nominated as Data Processor for this purpose. Moreover other companies of Bally group, duly nominated as data processors can be involved in the data processing in relation to the managing of the Site and relevant services and functionalities.

4. Data communication

Personal data will be accessible within Bally organization by the internal and external personnel and may be communicated to and shared any other company within the Group. located in countries inside and/or outside of the European Economic Area (“EEA”). However all security and privacy measures have been put in place at Group level in order to ensure an adequate level of data protection irrespective of the geographical location of each Group company that is the receipt of the above mentioned personal data.
Data will be transferred to extra EEA companies of the Group with the user’s consent which id free and optional.
User personal data may also be communicated to professionals, independent consultants, third party companies to which Bally may revert to in relation to performance of technical and organizational services for the purposed above specified.
The aforementioned subjects that receive user's personal data will process them as Data Controllers, Data Processors and/or Persons in Charge of Processing Data as the case may be, for the same purposes above specified and according to applicable data law protection.
Data Processors and the subjects to which personal data may be communicated will remain at user disposal upon request at Bally.

5. Automatic data collection tools

The Site uses automatic systems of data collection such as cookies.
