Privacy Policy

1. Scope and agreement

1.1 This Privacy Policy (hereinafter referred to as the "Privacy Policy") applies to the www.bally.jp Website (hereinafter referred to as the "Website") and covers the processing of personal data for the use of both the services and functions provided on the Website (including the Online Store) gained through users solely looking at the Website, or through users providing user information for free by completing certain forms or by email in order to browse the Website as well as to access certain sections within the Website, or to receive newsletters or advertisement and promotional information. If the user makes purchases as a guest, the data acquired for profiling purposes will not be processed.

1.2 This Privacy Policy identifies the data controller(s) responsible for the personal data collected and processed on this Website, and specifies which personal data is collected, the processing and purpose of the user’s personal data and how it is exchanged with third parties, the security measures taken to protect the data, how the user can check the processing of his/her data, and the exercise of his/her rights in relation to his/her data.

1.3 When using the Website, the user consents to us collecting, using, disclosing, holding, storing, and transferring the user's personal data as set out in this Privacy Policy, the General Terms and Conditions of Sale, and the General Terms and Conditions of Use. The Company may amend this Privacy Policy with any new terms and conditions coming into effect upon the date they are posted on this Website.

1.4 The user's personal data is only provided for this Website and not to other websites. However, the user may consent to the provision of personal data to other websites through links and activities provided by third parties.

2. Data administrator

2.1 The data administrator of this Website is Bally Japan Ltd., with registered offices at 1-1-1 Nishi-Shinbashi, Minato-ku, Tokyo, Japan (hereinafter referred to as “Bally” or the “Company”).

2.2 As stated in the General Terms and Conditions of Sale, the online store on this Website is managed by Bally Japan Ltd., which has its registered office at 1-1-1 Nishi-Shinbashi, Minato-ku, Tokyo. The Company manages the sales and transactions carried out on the Website, including processing orders, selling and delivering products, processing returns and warranties and any other activities necessary for the sale of products on the Website. In order to manage and fulfil the activities necessary for the sale of products on our Website, we process user data (e.g. name, address, user credit card details).

3. Collection of personal data

3.1 The user may browse the Website without identifying themselves to us or disclosing any personal data about themselves. If a user chooses to provide us with personal data in order to use the services and functions on the Website, they will no longer be anonymous to us.

3.2 We collect the following types of personal data (hereinafter collectively referred to as “data”) in order to enable the customer to use and access our Website and related e-commerce services, and to customise our Website for the customer and improve its usability.

(a) Information automatically collected: Specific data enabling the specification of a user’s identity in the case of computer systems and processing programs required to run the Website's logs during normal operations, when its acquisition is unavoidable (when internet protocols are used), for processes dependent on the nature of the data itself, and when correlated to data belonging to third parties. Including, but not limited to device ID or unique identification code, device type, location information, computer information, connection information, page view statistics, traffic to and from this Website, referring URLs, IP addresses, standard web log information, anonymous information collected by cookies and web beacons (hereafter collectively referred to as “browsing data”). The Company shall collect browsing data on access to our Website solely for the purpose of compiling anonymous statistics, monitoring the correct functioning of our Website, and enhancing the functionality and content of our Website.

(b) Data voluntarily provided by users: Personal data voluntarily provided by the user through e-mail, by using the functions of the Website, by requesting services offered on the Website, by accessing certain sections of the Website, and by filling in certain forms to use the e-commerce services offered on the Website. Name, gender, email address, telephone number, physical contact details (depending on the service used) and, in some cases, financial information such as credit card and bank account numbers, as well as postal and billing addresses and any other information the Company may ask users to provide in order to purchase products on our Website, or any additional personal information we may ask the customer to provide to offer our services.


3.3 Minimum age
Bally takes the protection of children's personal data very seriously. Although the definition of a child in the laws and regulations of each customer’s country or region may vary, Bally considers anyone under the age of 20 to be a child. Children may not create their own user accounts without the consent of their parents or legal guardians. Anyone under 20 years of age must first obtain parental consent and purchase our products directly or indirectly from a parent or guardian's account. If we discover that we have collected personal data about a child without prior consent from a person identified as a parent or guardian, we will delete all data as soon as possible. 4. Cookies and automated data collection tools

This Website uses automatic data collection systems such as cookies. Cookies are devices that are sent to an internet user's hard disk. It does not contain any readable information, but it can be used to make a link between internet users and the user's personal data supplied from use of the Website (e.g. the user's IP address, the user's Website user history, the user's choice of services offered on the Website or other information about user preferences indicated when purchasing products, or other information about the user's preferences). Cookies are distributed by the server, and no one can access the information contained in the cookie. Such information and data are collected directly and automatically by the Website and are processed collectively and anonymously.

5. Data transmission

5.1 Use of the services on this Website and access to the services and functions offered on this Website, such as the online store and related e-commerce services, requires data transmission by the user. If you do not provide the data, you will not be able to access or use the services and functions.

5.2 Data transmission for marketing purposes is always voluntary and optional. Failure to submit data for such activities does not prevent you from using the services and functions provided by this Website.

6. Processing methods and objectives

6.1 Data is processed manually or by electronic tools for the following purposes:

(a) Operational management of website browsing and related access data.

(b) Data security and website security controls.

(c) The provision of the e-commerce services offered on the Website.

(d) The provision of any other services requested by the user as described when the information is collected.

6.2 Furthermore, with the free and voluntary consent of the user, the Company may process data for the purposes of defining the profiles of individuals or entities (user profiling), for marketing, or for sending users information and updates, in particular by means of newsletters, emails, text messages (SMS), multimedia messages (MMS) and/or by electronic and other means, including but not limited to instant messages (e.g. applications such as WhatsApp and WeChat) about our products or initiatives, offers, limited sales, promotional campaigns, events, shows, or similar events we are hosting or participating in, for the purposes of inviting users to such events. The user can always object to the processing of their data for marketing purposes and/or the distribution of promotional information by emailing privacy@bally.ch.

6.3 We do not sell user data to third parties for their marketing purposes without the express consent of the user. We may combine user data with information we collect from other sources and use it to improve and customise our advertising and marketing to users.

7. Data storage and protection

7.1 The data collected is stored and processed by electronic systems within Bally and at other sites around the world. We will retain your personal data for the purposes set out in section 6 for seven years from the date of subscription. However, in some cases, personal data may be retained for longer periods if there is an obligation to retain personal data for a longer period in accordance with legal, tax or accounting requirements. After this period, your data will be permanently deleted or anonymised in an irreversible manner.

7.2 We protect user data using technical and managerial security measures to reduce the risk of loss, misuse, unauthorised access, disclosure, or alteration. The protective measures we use include firewalls, data encryption, control of physical access to our data centres, and authorisation control of information access.

7.3 We have taken steps to ensure that the user data we collect is accurate and up-to-date, and we offer users the opportunity to update their information in accordance with the provisions of this Privacy Policy.

8. Data exchange and disclosure

8.1 Data can be accessed by the necessary internal and external personnel within our organisation.

8.2 We can also share user’s data with the following partners:

(a) Other companies within the Bally Group. All security and privacy measures are in place for the whole Bally Group to ensure an appropriate level of data protection regardless of the geographical location of the Bally Group companies that receive the above mentioned data. Bally Group companies can only use your data to send marketing invitations if you have consented to the Bally Group companies' services and will use your data in accordance with their privacy policies and applicable law.

(b) Professionals, independent advisers, credit bureaus, banks and financial institutions, or third-party companies consulting on the performance of technical and organisational services, or service providers contracted to help with operations (such as website operations, payment services, shipping, fraud investigations, payment collection, affiliate and reward programmes).

(c) Any other third party to whom the user has expressly asked us to send information about him or her. For example, when a user requests customer support directly via our official social media or other digital communication channels. In such cases, the data will be disclosed to other third-party entities responsible for such third-party platforms (e.g. WhatsApp, WeChat) and will be subject to those entities' terms of use and privacy policies. Before using these communication channels, please ensure that you read and understand the applicable terms of use and the privacy policy of each organisation.

(d) Law enforcement or supervisory authorities or authorised third parties responding to confirmed requests concerning criminal investigations, suspected unlawful activities or other activities involving the Website that may give rise to legal liability for us or our users.

(e) Any other entity with which the Company plans to merge with or which is to acquire the Company. In the event of such a merger, we will require the merged company to comply with our privacy policy with regard to user data.

8.3 The above-mentioned party acquiring the user's data will process the data as data controller or joint data controller, data processor or supervisory data processor in accordance with circumstances and in accordance with the applicable data protection law for the same purposes as those purposes stated above. Our users can request at any time a list of data processors and those to whom data has been passed.

8.4 If we use or disclose user data for any other purpose not set out in this Privacy Policy, we shall notify the user in advance.

9. Rights of the parties concerned

9.1 The user has the right to obtain a copy of their information at any time and to request that any errors are corrected. 9.2 Users can withdraw their consent to receive advertising and promotional material by email at any time by clicking on the "Unsubscribe" link in all notices sent by us or other companies in the Bally Group.
